These Terms of Service ("Terms") are an agreement between you and Jody ("Jody", "we", "us"), a sole proprietorship, for the website at jodytracks.com and its services, including Jody Development Activity. By creating an account, subscribing, or using the service, you agree to these Terms and to our Privacy Notice. If you use Jody for a brokerage or other business, you confirm you may accept these Terms for it. If you do not agree, do not use the service.
Jody provides reports, monitoring and alerts about proposed, approved and active development projects, drawn from public-source information. Jody is an information service. It is not a real-estate broker, does not facilitate real-estate transactions, does not provide mortgages, and does not provide investment, legal, financial or real-estate advice.
You must provide accurate account information and keep your sign-in secure. You are responsible for activity under your account. An individual agent can register for their own single-person account, and is responsible for that account. Brokerage, team and enterprise accounts are arranged with Jody by custom quote and managed by the brokerage owner, who is responsible for the people the brokerage invites.
Jody Development Activity offers a Professional plan for individual real estate agents at $79 per month. The subscription includes 100 new Development Activity reports each month.
Existing reports may be reopened, shared with clients, downloaded, or printed without using another report. A report containing no development data for its requested area does not use one report.
Eligible new accounts may receive 10 free evaluation reports without purchasing a subscription.
Brokerage, team, and enterprise plans are available by custom quote. Their pricing, report allowances, and authorized users are governed by the applicable plan agreement.
The Professional plan costs $79 per month, shown before checkout. You authorize recurring charges of that amount, plus any applicable taxes, to the payment method you provide, until you cancel.
The subscription renews automatically each month at the then-current price unless you cancel before the renewal.
You can cancel at any time. Cancelling prevents the next renewal charge. Paid access continues through the end of the billing period you have already paid for. After that, the account returns to the applicable free level, and reports you have already saved remain accessible. Cancelling is separate from asking for a refund.
For subscriptions purchased through Paddle, customers may manage or cancel their subscriptions using the subscription-management link in their Paddle receipt or by visiting https://paddle.net. Cancellation prevents future renewal charges. It does not automatically refund payments already made.
Refunds and cancellations are separate processes.
For purchases processed through Paddle, refund requests are handled by Paddle in accordance with its Refund Policy at https://www.paddle.com/legal/refund-policy and applicable consumer-protection laws.

The payment provider and applicable terms are identified during checkout.
For orders processed through Paddle, Paddle acts as the online reseller and Merchant of Record. Paddle handles payment collection, applicable transaction taxes, order-related billing inquiries, returns, and refunds.
Jody remains responsible for delivering and supporting its Development Activity reporting services.
Transactions handled by another authorized payment provider remain subject to the terms of the provider identified at checkout.
Real-estate professionals and brokerages may use Jody in the ordinary course of their professional work, including to research properties and to inform their clients.
You may share Jody reports you generate with your own clients and prospects, including by link, download or print, for the purpose of informing them about a property. Keep source links and the report's coverage and limitation statements with the report, and do not present a report as your own research or as a guarantee.
You may not: scrape, crawl or bulk-download Jody data; resell, redistribute or sublicense Jody's database or raw datasets; offer Jody or its reports as a competing data product or white-label service; misrepresent Jody information; interfere with or attempt to break the security or operation of the service; share account access outside your brokerage; or use Jody to harass others or break the law.
Jody summarizes selected official public records from covered sources. Public records can be incomplete, delayed, or amended, and coverage varies by place. A report may not include every project or change. Each project links to its official source so you can verify it.
Jody information is for general information only. It is not legal, financial, investment, appraisal or real-estate advice. Verify anything you plan to act on with the relevant authority or a qualified professional.
Jody, its software, design and compilation of information belong to Jody or its licensors. Underlying public records remain public records. We grant you a limited, non-exclusive, non-transferable right to use the service and your reports as these Terms allow.
We work to keep the service available but do not promise uninterrupted access. Features and coverage may change as the product evolves. We may update these Terms and will update the date above; continued use after a change means you accept it.
We may suspend or end access for misuse, for breach of these Terms, or to protect the service or others. You may stop using Jody at any time.
To the extent permitted by law, the service and all reports are provided "as is" and "as available," without warranties of any kind, including accuracy, completeness, timeliness or fitness for a particular purpose.
To the extent permitted by law, Jody is not liable for indirect, incidental, special or consequential damages, or for decisions made in reliance on a report. Our total liability for any claim relating to the service is limited to the amount you paid Jody for the service in the three months before the claim. Nothing in these Terms limits liability that cannot be limited by law.
